Confidentiality for Victims of Domestic Violence in New York

The state of New York prohibits many types of discrimination against domestic abuse victims. It is unlawful for any insurance company to deny or cancel a policy, refuse to renew a policy, set a limit of coverage, or base insurance rates on the basis of being a victim of domestic abuse. If you and/or your child have experienced domestic violence, and you have obtained a valid Order of Protection directly related to the abuse, US Resource Assistant will take appropriate actions to protect you and/or your child's information. This includes safeguarding your name, address, and phone number.

Miscellaneous

This agreement and the resolution of any dispute related to this Agreement or the site shall be governed by and construed in accordance with the laws of New York in the United States of America, without giving effect to any principles of conflicts of law.

US Resource Assistant failure to insist upon strict enforcement of any provision of this agreement shall not be construed as a waiver of any provision or right. Any legal action or proceeding between US Resource Assistant and you related to this agreement shall be brought exclusively in a federal or state court of competent jurisdiction venued in New York.

IN NO EVENT SHALL US Resource Assistant OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, BUSINESS, DATA OR PROFITS, LITIGATION AND THE LIKE, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
